These Terms of Service ("Terms") govern your use of the Indiana Tax Appeal website and services ("Service") operated by Indiana Tax Appeal ("we," "us," or "our"). By using the Service, you agree to these Terms.

Service Description

Indiana Tax Appeal provides automated property tax assessment analysis for Indiana properties. Our Service includes:

  • Property assessment analysis using four valuation approaches recognized by Indiana Tax Court: sales comparison, cost, income capitalization, and assessment equity.
  • Generation of Form 130 (State Form 53958) petitions with pre-filled property data and valuation evidence.
  • PDF Report: Downloadable analysis report and Form 130 petition.
  • E-File Service: Professional filing with your county Property Tax Assessment Board of Appeals (PTABOA), case tracking, and hearing support.

Important Disclaimers

We are not licensed real estate appraisers. Our analysis uses IAAO-compliant methodology and DLGF published cost schedules, but it does not constitute a certified appraisal by a licensed appraiser.

This is not legal advice. Property tax appeals are administrative proceedings. We provide data-driven evidence and analysis, not legal representation. We are not attorneys and do not represent you before the PTABOA or the Indiana Board of Tax Review (IBTR).

Results are not guaranteed. Appeal outcomes are determined by county PTABOAs and the IBTR. We provide the strongest evidence-based analysis we can, but we cannot guarantee any specific outcome.

Your assessment may increase. Under Indiana law, submitting evidence in a property tax appeal can result in an assessment increase if the evidence supports a higher value. The IBTR has stated: "once probative evidence is submitted on the record, the Board cannot turn a blind eye to its value" (Echo Lake LLC). Our analysis flags this risk when applicable, but you accept this possibility by filing an appeal.

Data Accuracy

  • Our analysis is based on public records from county assessors and the Indiana Department of Local Government Finance (DLGF).
  • Public records may contain errors in square footage, year built, building grade, condition, or other property characteristics. You should verify that the property data in your report matches your actual property.
  • Comparable sales data is historical and may not reflect current market conditions.
  • Market data used in the income capitalization approach (capitalization rates, market rents, vacancy rates, operating expense ratios) is sourced from published industry surveys and updated annually. These are market-derived estimates, not property-specific actuals.
  • Valuation estimates are automated approximations based on available data. They are not guaranteed values and should not be relied upon as the sole basis for financial decisions.

Pricing and Payment

  • Property analysis is free. Payment is required only for report generation or e-filing.
  • PDF Report: 10% of estimated annual tax savings, minimum $50, rounded up to the nearest $50.
  • E-File Service: 50% of estimated annual tax savings, minimum $100, rounded up to the nearest $100.
  • Prices are calculated at the time of checkout based on the current analysis.
  • Payments are processed securely by our payment processor. We do not store credit card information on our servers.
  • Refund policy: If your appeal is denied at PTABOA, contact us for a case review. Refund eligibility is evaluated on a case-by-case basis.

Appeal Deadlines

  • Filing deadlines for Indiana property tax appeals are set by state law and vary by county.
  • The standard deadline is June 15 of the assessment year if the Form 11 notice of assessment is mailed before May 1.
  • Missing the filing deadline is fatal — no statutory extension exists for the initial Form 130 filing.
  • We display deadline information in our analysis, but it is your responsibility to verify the exact deadline with your county assessor's office.
  • We are not liable for missed filing deadlines.

Your Obligations

  • Provide accurate contact information when creating your account.
  • Verify that the property data in your analysis and Form 130 matches your actual property before filing.
  • Review and sign the Form 130 before it is submitted on your behalf.
  • Report any known errors in your property record card that may affect the analysis (incorrect square footage, missing improvements, wrong year built, etc.).
  • Do not use the Service for properties you do not own or do not have legal authority to appeal.

Intellectual Property

  • Our valuation algorithms, market data compilations, analysis reports, and website content are proprietary and protected by applicable intellectual property laws.
  • Form 130 is an Indiana state form (State Form 53958) prescribed by the DLGF and is not our intellectual property.
  • You may use reports you have purchased for the purpose of filing property tax appeals with Indiana county assessors and tax review boards.

Limitation of Liability

  • We are not liable for appeal outcomes, including assessment increases that may result from evidence submitted during the appeal process.
  • Our maximum liability to you is limited to the amount you paid for the Service.
  • We are not liable for errors or omissions in public records data sourced from county assessors or the DLGF.
  • We are not responsible for changes in assessed values, tax rates, or Indiana tax law that occur after your analysis date.
  • The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Account Termination

You may close your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity. Upon termination, your access to the Service will cease, but we may retain records as required by law or for legitimate business purposes.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Marion County, Indiana.
